The plain language version: HeyAggy is a free navigation guide, not a health service or legal advisor. We help you understand the aged care system — your decisions are your own. We take our duty of care to reasonable accuracy seriously, but the system changes frequently and you should always verify important information with a qualified professional. If you subscribe to AggyPlus, you can cancel any time and keep access until the end of your billing period.

1. About HeyAggy

HeyAggy is operated by Marli Briffa, ABN [Marli's ABN], trading as HeyAggy ("HeyAggy," "we," "us," "our"). HeyAggy is a free aged care navigation platform for Australian families. We are not an aged care provider, a health service, a medical service, a legal service, or a financial advisory service.

By accessing or using HeyAggy, including the free plan, AggyPlus, AskAggy., or any templates or resources, you agree to these Terms. If you do not agree, please do not use the service.

2. What HeyAggy is — and is not

HeyAggy provides aged care navigation information, personalised plan generation, and AI-assisted navigation through AskAggy. This is general information and navigation assistance only. It is not:

  • Medical advice, clinical assessment, or diagnosis
  • Legal advice, including advice about Powers of Attorney or Advance Care Directives
  • Financial advice, including aged care financial planning or investment advice
  • A referral service with financial relationships with any aged care provider
  • A replacement for consultation with a qualified GP, solicitor, financial adviser, or aged care specialist

For decisions requiring professional judgement — including care eligibility, financial assessments, legal documents, and clinical matters — you must consult a qualified professional. HeyAggy can help you understand the landscape and know what questions to ask, but the decision and responsibility remain yours.

3. Accuracy of information

We make reasonable efforts to ensure the information HeyAggy provides is accurate, current, and relevant to the Australian aged care system. However, the aged care system changes regularly — program names, funding levels, means testing thresholds, wait times, and eligibility criteria can change without notice.

We cannot guarantee that all information is current at the time you access it. Indicative costs, wait times, and funding levels are estimates based on current published information and should be verified with My Aged Care (1800 200 422) or a relevant professional before making decisions.

We acknowledge our responsibility to maintain reasonable accuracy and will update information when we become aware of material changes to the aged care system.

4. AskAggy. — AI navigation assistant

AskAggy. is an AI-powered navigation assistant that helps you understand and navigate the aged care system. It is designed for navigation only — not medical advice, clinical recommendations, or diagnosis.

AskAggy. operates within a constrained system that prevents it from providing clinical recommendations. However, AI systems can make mistakes. Do not rely solely on AskAggy. for any decision that affects someone's health, legal status, or financial position. Always verify with a qualified professional.

AskAggy. includes monthly message limits as described in your plan. When a limit is reached, you will be offered the option to purchase additional messages. The monthly limit is a product design decision, not a safety measure — Aggy will always direct you to My Aged Care (1800 200 422) for urgent matters regardless of your message count.

5. Free plan

The free plan is permanently free and requires no account. Your assessment answers and plan exist only in your browser session and are not stored on HeyAggy's servers. When you close or refresh the page, your session data is gone. The free plan will always remain available at no cost.

6. AggyPlus subscription

Plans and pricing:

  • AggyPlus Monthly: $14.90 AUD per month, billed monthly
  • AggyPlus Annual: $149 AUD per year, billed annually (equivalent to 2 months free)
  • JIC Standalone: $4.90 AUD per month (Just In Case feature only)

Billing: Payments are processed by Stripe. By subscribing, you authorise HeyAggy to charge your nominated payment method on a recurring basis until you cancel. All prices are in Australian dollars and include GST where applicable.

Cancellation: You may cancel your subscription at any time through your dashboard settings or by emailing aggy@heyaggy.com. Cancellation takes effect at the end of your current billing period. You retain full access to AggyPlus until that date. No pro-rata refunds are provided for partial billing periods.

Pausing: You may pause your subscription for 30 days once per 12-month period. Your plan, documents, and data are preserved during a pause.

Price changes: We will give you at least 30 days' notice of any price increase, with the option to cancel before the new price takes effect.

Refunds: We do not generally provide refunds for subscription periods already paid. If you believe you were charged in error, contact aggy@heyaggy.com within 14 days and we will review your situation.

7. Physical products

HeyAggy offers printed template packs and fridge magnets as optional add-on purchases. These are fulfilled by a third-party print provider. By placing an order, you agree that your name and postal address will be shared with our fulfilment partner for delivery purposes only.

Delivery is estimated at 5–10 business days within Australia. We are not responsible for delays caused by Australia Post or our print partner. If your order does not arrive within 15 business days, contact aggy@heyaggy.com.

Physical products are non-refundable unless the item arrives damaged or is materially different from what was ordered.

8. Personal templates and printed materials

HeyAggy provides printable templates including emergency cards, carer logs, ACAT preparation guides, and family conversation guides. These are personal document templates only — not clinical records, not official documents, and not a substitute for professional advice.

Information you enter into templates and print is your own personal record. HeyAggy does not store the content of completed templates (unless you explicitly save it to your AggyPlus account). We accept no liability for decisions made based on information recorded in these templates.

Emergency information templates should include the statement: "This information was prepared by the individual or their family and may not reflect current medical status. Verify with treating healthcare provider." This statement is included in all HeyAggy-generated emergency templates.

9. Privacy and data

Your privacy is governed by our Privacy Policy, which forms part of these Terms. In the free version, nothing is stored. In AggyPlus, data is stored securely and never shared without your authorisation.

You have the right to access, correct, and delete your data at any time. Data deletion cascades across all systems within 30 days of your request.

10. Just In Case

The Just In Case feature sends your nominated documents, letters, and contacts to a person you designate, either manually or after an inactivity period you set. You are responsible for:

  • Keeping your nominee's contact details current
  • Ensuring the documents and information in your account are current
  • Informing your nominee that they may receive this information

HeyAggy is not responsible for the consequences of information sent via Just In Case being out of date, incorrect, or sent to an incorrect recipient due to outdated contact details you have provided.

11. Limitation of liability

To the fullest extent permitted by law, HeyAggy's liability to you for any loss or damage arising from your use of the service is limited to the total amount you have paid to HeyAggy in the 12 months preceding the event giving rise to the claim, or $100 AUD, whichever is greater.

HeyAggy is not liable for:

  • Decisions you make based on information from HeyAggy or AskAggy.
  • Outcomes of aged care assessments, provider selections, or care arrangements
  • Loss of data due to circumstances beyond our reasonable control
  • Indirect, consequential, or special loss of any kind

Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot be excluded by contract, including statutory guarantees that services will be rendered with due care and skill.

12. Intellectual property

All content on HeyAggy — including the Aggy character, the founder story, the assessment questions, the plan content, the guides, and all copy — is owned by HeyAggy and protected by Australian copyright law. You may not reproduce, copy, or distribute any content without written permission.

The name "HeyAggy" and the Aggy character are the subject of trade mark registration (or pending registration) in Australia. Use of these names or the Aggy character without permission is prohibited.

13. User conduct

You agree not to use HeyAggy to:

  • Provide false or misleading information
  • Attempt to reverse-engineer, copy, or replicate the HeyAggy service
  • Use AskAggy. to generate content for commercial purposes without permission
  • Circumvent any security measures or access controls
  • Use the service in a way that could harm other users or the platform
14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have an account) or by displaying a notice on the website. Continued use of HeyAggy after the effective date of changes constitutes acceptance of the new Terms.

15. Governing law and disputes

These Terms are governed by the laws of Victoria, Australia. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

Before commencing formal proceedings, you agree to contact aggy@heyaggy.com in good faith to resolve the dispute. We will acknowledge your complaint within 48 hours and aim to resolve it within 10 business days.
